Terms of Service for Skrapior

1. Who We Are

Skrapior is a B2B lead-discovery tool operated by Skorpiondigital Private Limited,  ("Skorpiondigital private limited", "we", "us", or "our").

These Terms of Service ("Terms") govern your access to and use of the Skrapior website at skrapior.com and the Skrapior service (collectively, the "Service"). By creating an account, accessing the Service, or making a purchase, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years old and capable of entering into a legally binding contract under the laws of your jurisdiction. By using the Service you represent and warrant that you meet these requirements and that the information you provide to us is accurate and current.

3. Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You agree to notify Skorpiondigital private limited immediately of any unauthorised use of your account.
  • You agree to provide accurate and complete information and to keep it up to date.

4. The Service

Skrapior helps B2B sales and marketing teams discover publicly listed business contact information from Instagram Business and Creator profiles — specifically, contact details (such as business email addresses) that the profile owner has chosen to publish for customer contact. Skrapior does not process or expose data from private accounts.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • use the Service to send unsolicited bulk email (spam) in violation of CAN-SPAM, GDPR / ePrivacy, the Indian IT Act, or any other applicable law;
  • process personal data without a lawful basis or required consent under applicable data-protection laws;
  • use the Service in a manner that violates the Terms of Service of Instagram or any other third-party platform;
  • resell, sublicense, or white-label the Service without prior written authorisation from Skorpiondigital private limited;
  • attempt to gain unauthorised access to any part of the Service, other accounts, or our systems;
  • reverse engineer, decompile, or otherwise attempt to extract the source code of the Service;
  • impersonate any person or misrepresent your affiliation with any entity.

6. Subscriptions, Billing and Taxes

  • Paid plans are billed in advance on a recurring basis (monthly or annual) unless otherwise stated at checkout.
  • You authorise Skorpiondigital private limited and its payment processors to charge your designated payment method for each billing cycle until you cancel.
  • Prices are stated in the currency shown at checkout and exclude applicable taxes unless explicitly stated otherwise.
  • You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period.

7. Refunds

Refund eligibility is governed by our Refund Policy, which forms part of these Terms.

8. Customer Data

You retain ownership of the data you submit to the Service ("Customer Data"). You grant Skorpiondigital private limited a limited, worldwide licence to host, process, and transmit Customer Data solely for the purpose of providing and improving the Service. We process personal data in accordance with our Privacy Policy.

You represent and warrant that any data you submit to the Service has been obtained lawfully and that you have the right to process it for the purposes for which you use the Service.

9. Intellectual Property

All software, content, trademarks, logos, and materials made available through the Service are owned by Skorpiondigital private limited or its licensors and are protected by intellectual-property laws. Skorpiondigital private limited grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for its intended purpose, subject to these Terms.

10. Service Availability and Changes

Skorpiondigital private limited aims to keep the Service available but does not guarantee uninterrupted operation. We may perform maintenance, modify features, or discontinue parts of the Service with reasonable notice where practicable.

11. Suspension and Termination

Skorpiondigital private limited may suspend or terminate your access to the Service if you breach these Terms or applicable law, with or without notice. You may stop using the Service at any time. Sections that by their nature should survive termination shall do so.

12. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, the aggregate liability of Skorpiondigital private limited for any and all claims arising out of or relating to the Service shall not exceed the total amount you paid to us in the twelve (12) months immediately preceding the event giving rise to the claim. Skorpiondigital private limited shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages.

14. Indemnification

You agree to indemnify, defend, and hold harmless Skorpiondigital private limited and its directors, officers, employees, and agents from and against any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising out of or relating to your breach of these Terms or your misuse of the Service.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. The courts of Indore, Madhya Pradesh, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms, subject to any mandatory consumer-protection laws of your jurisdiction.

16. Changes to These Terms

Skorpiondigital private limited may update these Terms from time to time. Material changes will be communicated through the Service or by email. Your continued use of the Service after the effective date of any change constitutes acceptance of the revised Terms.
